Terms of Service

1. Acceptance of Terms
Welcome to Bytmark. By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Bytmark ("we," "us," or "our"). By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
Bytmark is a personal bookmark manager application that allows you to:
- Save and organize bookmarks from websites and social media
- Create custom collections to categorize bookmarks
- Sync bookmarks across multiple devices
- Share collections with others (Pro feature)
- Use Ghost Share to remove tracking information from social media links
- Back up and export your bookmark data
- Search and manage your saved content
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.
3. Eligibility
To use Bytmark, you must meet the minimum age requirements set by the Apple App Store or Google Play Store in your jurisdiction. By using the App, you represent and warrant that:
- You meet the minimum age requirements set by your app store
- You have the legal capacity to enter into these Terms (or have obtained parental/guardian consent if required)
- You will comply with these Terms and all applicable laws and regulations
If you are a minor in your jurisdiction, you represent that you have obtained consent from your parent or legal guardian to use the App.
4. User Accounts
Account Creation
To use Bytmark, you must create an account using one of the following methods:
- Email and password
- Google Sign-In
- Apple Sign-In
When creating an account, you agree to provide accurate, current, and complete information. You must keep your account information up to date.
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from your failure to protect your account information.
One Account Per User
You may only create one account per person. Creating multiple accounts to circumvent service limitations is prohibited and may result in account termination.
5. Subscription Plans
Free Plan
The Free plan includes:
- Up to 50 bookmarks
- Up to 6 collections (5 custom + 1 "Quick Saves")
- 1 manual backup slot
- Cross-device sync
- Collection notes up to 300 characters
Pro Plan
The Pro plan includes all Free features plus:
- Unlimited bookmarks
- Unlimited collections
- Collection notes up to 2,000 characters
- 7 backup slots
- Automatic daily backups
- Collection sharing
Subscription Options
Pro subscriptions are available as:
- Monthly: Recurring monthly subscription
- Annual: Recurring annual subscription at a discounted rate
- Lifetime: One-time payment for permanent access
Payment Processing
All payments are processed through Apple App Store (iOS) or Google Play Store (Android). Subscriptions are managed through RevenueCat and subject to the respective platform's terms and conditions.
By subscribing, you authorize us to charge your payment method for the subscription fee, any applicable taxes, and any other charges you incur.
Automatic Renewal
Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
Price Changes
We reserve the right to modify subscription prices. Price changes will not affect your current subscription period and will take effect upon renewal. We will notify you of price changes in advance.
Regional Pricing: Subscription prices may vary by country due to local currency, taxes, and App Store policies.
6. Cancellation and Refunds
Cancellation
You may cancel your subscription at any time through:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play Store → Subscriptions
- In-App: Profile → Current Plan → Manage Subscription
Upon cancellation, you will retain Pro access until the end of your current billing period. No refunds will be provided for the remaining period.
Refund Policy
All payments are non-refundable except as required by law or as explicitly stated in these Terms. Refund requests must be submitted through the App Store or Play Store, as applicable.
For lifetime purchases, refunds may be considered within 14 days of purchase on a case-by-case basis. Contact support@bytmark.com to request a refund.
Downgrade to Free Plan
When your Pro subscription expires or is cancelled:
- Your account will automatically revert to the Free plan
- You will retain all existing bookmarks and collections
- If you exceed Free plan limits, you cannot create new items until you delete existing ones or upgrade
- Automatic backups will stop
- Collection sharing will be disabled
7. Acceptable Use Policy
Prohibited Activities
You agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Use the App for any illegal, harmful, or fraudulent purpose
- Upload or share content that is unlawful, defamatory, obscene, or offensive
- Harass, abuse, threaten, or harm other users
- Impersonate any person or entity, or falsely claim affiliation
- Attempt to gain unauthorized access to the App, other accounts, or computer systems
- Use automated scripts, bots, or scrapers to access the App
- Reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's operation or servers
- Transmit viruses, malware, or other harmful code
- Circumvent any limitations or restrictions on your account
- Use the App for commercial purposes without authorization
Content Responsibility
You are solely responsible for the bookmarks, collections, and other content you create, save, or share through the App. We do not pre-screen user content but reserve the right to remove content that violates these Terms.
8. Intellectual Property Rights
Your Content
You retain all ownership rights to the bookmarks, collections, and other content you create in the App ("Your Content").
By using Bytmark, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide and improve the App services.
Third-Party Content
Bytmark allows you to save links to third-party content. You acknowledge that:
- Third-party content is owned by the respective content creators
- We do not claim ownership of any third-party content
- You are responsible for ensuring your use of third-party content complies with applicable laws and terms
Bytmark's Intellectual Property
The App, including its design, features, functionality, text, graphics, logos, icons, and software, is owned by Bytmark and protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, distribute, or create derivative works of the App
- Remove or alter any copyright or proprietary notices
- Use Bytmark trademarks without written permission
9. Public Collections
Pro users can make collections public and share them via link. When you make a collection public:
- Anyone with the link can view the collection and its bookmarks
- You grant us permission to display the collection to viewers
- Your username and profile information remain private
- You can make collections private again at any time
You are responsible for ensuring that public collections do not violate any laws or third-party rights.
10. Data and Backups
Your Responsibility
While we make reasonable efforts to back up user data, you are solely responsible for maintaining your own backups. We strongly recommend regularly exporting your bookmarks.
Data Loss
We are not liable for any loss, corruption, or deletion of your data, whether due to technical issues, user error, or any other cause.
Backup Limitations
- Free users: 1 manual backup slot
- Pro users: 7 backup slots + automatic daily backups
- Backup rate limit: 1 manual backup per 5 minutes
11. Account Termination
Termination by You (30-Day Deletion Policy)
You may request account deletion at any time through Profile → Login Methods → Delete Account. When you request deletion:
- Your account is scheduled for permanent deletion 30 days from your request. You will receive an email confirming the scheduled deletion date.
- During the 30-day period, you may continue using the App and may cancel (undo) the scheduled deletion at any time. If you do not cancel, your account and all associated data will be permanently deleted after the 30-day period.
- Once the 30-day period has ended and deletion is completed, this action cannot be undone.
- If you have an active subscription, you must cancel it through your app store before you can request account deletion.
Termination by Us
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Prolonged inactivity
- Any other reason at our sole discretion
Upon termination, your right to access and use the App immediately ceases. We are not liable for any loss resulting from account termination.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement
- Warranties regarding accuracy, reliability, or availability
- Warranties that the App will be uninterrupted or error-free
We do not guarantee that the App will meet your requirements or that any errors will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTMARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Loss of use or business opportunities
- Loss of goodwill
- Cost of substitute services
- Any other intangible losses
This limitation applies whether the claim is based on warranty, contract, tort, or any other legal theory, and whether or not we have been informed of the possibility of such damage.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify, defend, and hold harmless Bytmark, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your content and activities
15. Third-Party Services
The App integrates with third-party services including Supabase, Firebase, RevenueCat, Resend, Google Sign-In, and Apple Sign-In. Your use of these services is subject to their respective terms and privacy policies.
We are not responsible for the actions, policies, or content of third-party services. We do not endorse or guarantee any third-party service.
16. Changes to the App
We reserve the right to:
- Modify or discontinue any aspect of the App
- Change features, functionality, or limitations
- Update pricing for new subscriptions
We will make reasonable efforts to notify you of significant changes, but we are not obligated to maintain any particular features or functionality.
17. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Post the updated Terms in the App
- Notify you via email or in-app notification for material changes
Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.
18. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Dispute Resolution
If you have any dispute with us, you agree to first contact us at support@bytmark.com and attempt to resolve the dispute informally for at least 30 days before initiating any legal proceedings.
Arbitration
Any disputes arising from these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration, except where prohibited by law.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
19. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bytmark regarding the App.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet failures.
